    • Liability: We build durable software, but we provide our services "as is" without absolute guarantees of uninterrupted uptime. Our liability is limited as permitted by law.

    • Disputes: We prefer to resolve issues informally. If we cannot, disputes will be resolved through arbitration under United States law.

    • Termination: You can delete your account at any time. We can suspend or terminate accounts that violate these terms.

    Welcome to Mirai Forge, LLC. We are thrilled to have you here.

    By accessing or using our website (https://miraiforge.tech) and our suite of software applications, you are agreeing to be bound by these Terms of Service. We wrote these terms to clearly explain how our platform works, what we expect from you, and what you can expect from us. If you do not agree with these terms, please do not use our services.

    Mirai Forge is the foundation behind a suite of software products built around a single theme: Forge your future.

    The word "mirai" (未来) means future, and we view software creation as a craft. We are dedicated to building resilient, multilingual, and privacy-respecting tools that help you achieve your goals. Because our services are cloud-based and hosted across multiple regions (multi-residency) using Amazon Web Services (AWS), you can access your work from anywhere.

    Eligibility

    To use Mirai Forge, you must be old enough to consent to data processing in your jurisdiction. To comply with the Children's Online Privacy Protection Act (COPPA) and the General Data Protection Regulation (GDPR), you must be at least 13 years old to use our services if you live in the United States, and at least 16 years old if you live in the European Economic Area.

    Service Availability

    We strive to make our software as durable and reliable as a well-crafted physical tool. However, because we rely on internet infrastructure and third-party cloud providers, we cannot guarantee 100% uptime. We will always do our best to notify you in advance of any planned maintenance.

    3. Your Account

    To use most features of our platform, you need to register for an account.


    Registration and Security


    When you create an account, you must provide accurate and up-to-date information. We require this so we can securely manage your access and communicate important updates to you.

    You are responsible for everything that happens under your account. Because we take security seriously (operating under a SOC 2 aligned framework), we strongly encourage you to enable Two-Factor Authentication (2FA). You must keep your password confidential and notify us immediately at hello@miraiforge.tech if you suspect any unauthorized access.

    To protect your personal information against loss, theft, unauthorized access, disclosure, copying, use, or modification, we implement comprehensive security safeguards. These include technical measures (such as SSL/TLS encryption and firewalls), administrative protocols (such as strict access controls and training for our staff), and physical safeguards (managed via our AWS infrastructure). The nature of the safeguards varies depending on the sensitivity of the information that has been collected.

    Account Sharing

    Your account is personal to you. To maintain security and proper access controls, you may not share your login credentials with others.

    Account Deletion

    You have the right to terminate your account at any time through your account settings. When you delete your account, we will delete your associated data in accordance with our Privacy Policy.

    4. Acceptable Use

    We built Mirai Forge to help you create. To keep our platform safe and functional for everyone, we have strict rules about how our software can be used.

    What You Can Do

    You are encouraged to use our tools to build, organize, and manage your projects, businesses, and personal goals in a lawful manner.

    What is Prohibited

    You agree not to engage in any of the following activities:
    • Illegal Acts: Using our platform to violate any local, state, national, or international law.
    • Abuse: Harassing, threatening, or harming others, or uploading malicious content (like malware or viruses).
    • Interference: Attempting to bypass our security measures, access controls, or SSL/TLS encryption.
    • Scraping: Using automated systems (bots, spiders) to extract data from our platform without our explicit written permission.
    • Infrastructure Overload: Intentionally placing an unreasonable load on our AWS cloud infrastructure.

    Consequences of Violations

    If we determine that you have violated these rules, we reserve the right to suspend or terminate your account immediately, without a refund, to protect our platform and other users.

    5. Content & Intellectual Property

    We believe in a fair balance of ownership. You own your work, and we own our tools.

    Your Content

    You retain full ownership of all the data, text, files, and information you upload or create using Mirai Forge. We claim no ownership over your creations. By using our service, you grant us a limited, secure license to host, store, and display your content solely for the purpose of providing the service to you.

    Our Intellectual Property

    Mirai Forge, LLC owns the platform, the code, the design, and the brand (including the "Forge your future" trademarks). You may not copy, modify, or distribute our software or brand assets without our permission.

    6. Payments & Billing

    We offer paid features to sustain our business and continue crafting high-quality software.

    Pricing and Billing Cycles

    All pricing is clearly displayed on our website prior to purchase. Depending on your selection, you will be billed on a recurring cycle (e.g., monthly or annually).

    Secure Payment Processing

    We use Stripe to process all financial transactions. For your security, Mirai Forge does not store your credit card numbers on our servers. All payment data is tokenized and handled directly by Stripe's secure infrastructure.

    Refunds and Cancellations

    You can cancel your subscription at any time from your account settings. Cancellations take effect at the end of your current billing cycle. We offer a 14-day money-back guarantee for new subscriptions. If you are unhappy with the service within your first 14 days, contact us for a full refund.


    7. Privacy

    Privacy is a core pillar of Mirai Forge. We respect your data and process it transparently.

    By using our service, you acknowledge our data practices as detailed in our Privacy Policy. We comply with major global privacy frameworks, including the GDPR (across all EU/EEA member states), the California Consumer Privacy Act (CCPA/CPRA), all other US State Privacy Laws, and the Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada.

    Data Collection, Purpose, and Limiting Collection:
    To provide our services, we collect personal information from the following categories of sources: directly from you (e.g., when you register or enter payment details) and automatically through your use of our platform (e.g., via cookies and AWS infrastructure logs). We collect this information for specific business and commercial purposes, including: providing and maintaining our software, processing secure payments, ensuring platform security, and improving our tools. In accordance with PIPEDA and other privacy laws, we limit the collection of personal information to that which is strictly necessary for these identified purposes. We will not collect personal information indiscriminately.

    Consent:
    We obtain your meaningful consent for the collection, use, and disclosure of your personal information before or at the time of collection. Depending on the sensitivity of the data, this consent may be express (e.g., checking a box to agree to these terms or opting in to specific features) or implied (e.g., voluntarily providing information necessary to use a requested service). You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting us.

    Lawful Basis for Processing (GDPR):
    For users in the European Economic Area (EEA), we process your personal data under the following lawful bases:

    • Performance of a Contract: To provide our services and fulfill our obligations under these Terms.

    • Legitimate Interests: To ensure platform security, prevent fraud, and improve our software.

    Third-Party Data Sharing (Openness):
    We are committed to openness regarding our data handling practices. We do not sell your personal data. We only share your information with trusted third-party service providers necessary to operate our platform. This includes our cloud hosting provider (AWS), our payment processor (Stripe), and essential analytics or communication tools. All third-party processors are bound by strict data processing agreements to ensure they meet GDPR, PIPEDA, and other regulatory standards.

    Key Privacy Commitments:

    • Security: We protect your data using SSL/TLS encryption in transit, Data Encryption at Rest, and comprehensive administrative and physical safeguards appropriate to the sensitivity of the information.

    • Retention: We retain your personal data for as long as your account is active or as necessary to provide our services. Once you delete your account, your data is removed from our active systems within 30 days. We may retain certain information beyond this period only as required by law or for legitimate business purposes (e.g., financial record-keeping or resolving disputes).

    • Your Rights (Including GDPR, CCPA, and PIPEDA): You have the right to know what personal information we collect (including categories and specific pieces of data). You also have the right to access, review, rectify (correct), erase (delete), and port your data at any time. Under PIPEDA, Canadian residents have the specific right to access their personal information, challenge its accuracy and completeness, and have it amended as appropriate. Under the GDPR, EU residents additionally have the right to restrict processing, object to processing (including profiling), and withdraw consent at any time.     • Opt-Out Mechanism: We do not sell your personal information to third parties.     • Non-Discrimination: We will never discriminate against you for exercising your privacy rights. You will not be denied goods or services, charged different prices, or provided a different quality of service for exercising your CCPA, GDPR, or PIPEDA rights.


    8. Disclaimers & Limitations

    We take pride in our craftsmanship, but legal realities require us to set clear boundaries regarding our liability.

    "As Is" Service

    Mirai Forge is provided on an "as is" and "as available" basis. While we build our software to be highly resilient, we do not warrant that the service will be entirely free of bugs, interruptions, or errors. We disclaim all warranties, whether express or implied, including warranties of merchantability or fitness for a particular purpose.

    Limitation of Liability

    To the maximum extent permitted by law, Mirai Forge, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, resulting from your use of our platform. In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim.

    Note: Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

    9. Dispute Resolution

    If something goes wrong, we want to fix it fairly and efficiently.

    Informal Resolution First

    Before filing any formal legal claim, you agree to try resolving the dispute informally by contacting us at hello@miraiforge.tech. We will do our best to resolve the issue within 30 days.

    Arbitration

    If we cannot resolve the dispute informally, you and Mirai Forge, LLC agree to resolve any claims through final and binding arbitration, rather than in court. The arbitration will take place in the United States.

    Class Action Waiver

    You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

    10. Changes & Termination

    Software evolves, and our terms must occasionally evolve with it.

    Modifying These Terms

    We may update these Terms of Service from time to time to reflect changes in our business, technology, or legal requirements. If we make material changes, we will notify you via the email address associated with your account or through a prominent notice on our platform before the changes take effect. Your continued use of the service after the effective date constitutes your acceptance of the new terms.

    Termination by Us

    We reserve the right to suspend or terminate your access to Mirai Forge at our discretion, without notice, if you breach these Terms of Service or if we are required to do so by law.

    11. General Legal

    • Governing Law: These terms are governed by the laws of the United States, without regard to conflict of law principles.
    • Severability: If any part of these terms is found to be unenforceable or invalid, that specific section will be modified to reflect the parties' intention as closely as possible, and the rest of the terms will remain in full effect.
    • Entire Agreement: These Terms of Service, along with our Privacy Policy, constitute the entire agreement between you and Mirai Forge, LLC regarding your use of the service.
    • Assignment: You may not assign your rights under these terms to anyone else. We may assign our rights to any successor in interest associated with our business.
